Welcome! These Terms & Conditions ("Terms") govern your use of the Dude Babe Design website (www.dudebabedesign.com, the "Site"), the purchase of products, and engagement of our creative services ("Services"). By using our Site, purchasing products, or engaging our Services, you agree to these Terms.
Definitions
"Products" means any physical item sold through our Site. "Services" means custom design, illustration, animation, or other creative work provided by Dude Babe Design LLC to the client under these Terms or a separate Service Agreement. "Client" means any person or entity purchasing Products or engaging our Services. "Site" means www.dudebabedesign.com and all related pages, content, and functionalities.
Eligibility
You must be at least 18 years old to use our Site, purchase Products, or engage our Services. By doing so, you confirm that you meet this requirement.
Purchases of products
When you place an order, a contract is formed once you complete the checkout process and pay for a product. All prices are listed in USD, and we reserve the right to correct any errors or update pricing at any time. Currently, we ship within the U.S. only, and shipping timelines are estimates that may vary. We do not offer returns except in cases where a product is damaged in transit. If a product arrives damaged, please contact us within 14 days and provide photos so that we can arrange a replacement or refund.
Services engagement
Services are provided after a written quote or proposal is accepted by the Client. A deposit is required to commence work, and the deposit percentage may vary by project; it will be specified in your proposal. Final deliverables are provided upon receipt of full payment. If a Client cancels a project after work has begun, payment for work completed to date is due.
Intellectual property
All creative work, content, designs, graphics, animations, and materials produced by Dude Babe Design (“Content”) remain the property of Dude Babe Design unless otherwise agreed in writing. Clients are granted a license to use the deliverables as specified in their Service Agreement. You may not copy, modify, distribute, or create derivative works from our Content without explicit permission.
Limitation of liability
To the fullest extent permitted by law, Dude Babe Design LLC, its employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site, Products, or Services. Our total liability is limited to the amount you paid to us for the specific Product or Service giving rise to the claim.
Disclaimer of warranties
Products and Services are provided "as is" without warranties of any kind, except as expressly stated in these Terms.
Governing law & dispute resolution
These Terms are governed by the laws of the State of Hawaii, without regard to conflict of law rules. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Honolulu County, Hawaii.
Additional terms
These Terms, along with any Service Agreements or referenced policies, constitute the entire agreement between the Client and Dude Babe Design LLC. If any provision is found to be invalid, the remainder of the Terms remain in effect. We may update these Terms occasionally, and changes will be posted with a new effective date. Continued use of our Site or Services constitutes acceptance of the updated Terms.
